Please read these terms and conditions (“Terms”) carefully before using the services provided by Odatsmi (“we,” “us,” or “our”). By placing an order or using our services, you agree to abide by these Terms.

1. Personalized Portrait Drawings

a. Ordering: To request a personalized portrait drawing, you must provide accurate and complete information. By placing an order, you confirm that you have the legal rights to use and reproduce the provided image(s) and that you grant us permission to create a drawing based on the image(s).

b. Artistic License: Our artists have the creative freedom to interpret and render the image(s) in a manner that they consider artistically appropriate. The final drawing may not be an exact replica of the original image(s).

2. Copyright and Ownership

a. Copyright Ownership: The copyright of the personalized portrait drawing, including any digital files, remains with Odatsmi and the artist. You receive a non-exclusive, non-transferable license to use the drawing for personal, non-commercial purposes only.

b. License Limitations: You may not reproduce, distribute, or use the drawing for any commercial purposes without obtaining explicit written permission from Odatsmi. Any unauthorized use of the drawing may constitute copyright infringement.

3. Delivery and Revisions

a. Delivery Times: We will provide an estimated delivery timeframe when you place your order. Delays may occur due to unforeseen circumstances, but we will make every effort to meet our delivery commitments.

b. Revisions: We offer a limited number of revisions to ensure you are satisfied with the drawing. Please review the drawing carefully once we submit a draft to your email and provide specific revision requests within 48 hours. After this period, additional revisions may be subject to an extra fee. If we did not received a response within 72 hours, we will start to print and ship the design. In which, you can no longer request and demand revisions. Due to the nature of customized digital art, we cannot offer refunds and returns unless we shipped the wrong art to you. This is why we send drafts first and wait for your approval before printing and shipping your orders.

4. Refunds and Returns

a. Satisfaction Guarantee: If you received an item but the design is not the one you ordered, please contact us within 72 hours of receiving the item. We will assess your concerns and may offer a replacement or refund at our discretion. We do not guarantee the resolution as every case is different. Provide us with a video while unboxing your package to qualify for replacements and refunds if you received the wrong item or design.

b. Refund Exclusions: We do not offer refunds for orders where you have approved the drawing, except in cases of error on our part. Items on sale are non-refundable and cannot be exchanged, nor returned.

c. Returns: We will not allow returns under any circumstances.

5. Termination

We reserve the right to terminate or suspend any order or service at our discretion if we believe it is necessary to protect our interests or the rights of others.

7. Governing Law

These Terms are governed by the laws of the United States of America, and any disputes will be subject to the exclusive jurisdiction of the courts of the United States of America.
